Intellectual Property Policy

Asfile.al (including but not limited to websites under such as Asfile.al) is an internet service provider as defined by the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. section 512 ("DMCA") and as such, Asfile.al complies with all provisions of the DMCA and copyright law including Intellectual Property Rights. Asfile.al responds promptly to claims of copyright infringement reported to its designated copyright agent. Asfile.al shall accommodate and not interfere with standard technical measures (as defined by the DMCA) used to identify and protect copyrighted works and shall disable access to or remove content that it believes in good faith may infringe the copyrights of third parties as well as discontinue service to users who repeatedly make such content available or otherwise violate Asfile`s.al Terms of Service (Agreements) .

 

Asfile.al has a zero tolerance approach towards copyright infringement, as such, we ask that you do not abuse the Asfile.al service by using it to distribute materials to which you do not have legal rights or authorization.

 

Should you have good faith belief that your copyright has been uploaded without your permission or authorization we suggest you send Asfile's.al registered agent a DMCA Notice of Copyright Infringement.
To complete a proper DMCA Notice, state the following information:

 

— I dentify yourself as an owner of the copyrighted work or exclusive rights that you believe were infringed, or a person acting on behalf of such owner.

— Provide information reasonably sufficient to permit Asfile.al to contact you, namely your contact information: name, address, phone number, and email address.

— Identify the copyrighted work that you believe is being infringed, or if a large number of works are being infringed, a representative list of the works.

— Identify the location of materials that allegedly are infringing your copyrighted work by providing Web URLs on the Asfile.al site that contain these materials. Please do not send attached images, pdf or other file formats, only list Asfile.al web URLs. Providing URLs in the body of an email is the best way to help us locate content quickly.

— State that you have "a good faith belief that use of the aforementioned material is not authorized by the copyright owner, its agents, or the law".

— State that the information in the notice is accurate, under penalty of perjury. To do so, include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the (copyright) owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

— Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

— Sign the notice. If you are providing notice by e-mail, a scanned physical signature or a valid electronic signature will be accepted.

— To expedite our ability to process your request, your Proper DMCA Notice must be sent to the Designated Agent of Asfile.al - forabuse@Asfile.al

 

Takedown Access

If you are the owner of copyrighted content in works that have been made available through the Asfile.al service without your permission, or the authorized representative of such a copyright owner, and you have given or may be required to give repeated notifications under the DMCA with respect to such material, you may request Content Owner's Takedown Access Account.

 

In dealing with copyright infringement and as an enforcement of our Zero Tolerance approach towards Copyright Infringement we work with content owners to deal with situations by selectively offering Content Owners a Takedown Access Account. Once access is granted, you may remove or disable access to materials made available through the Asfile.al service by submitting the URLs for those materials through your account. In submitting the URLs the infringing link will be automatically disabled. By submitting a URL using your Takedown Access Account, you will be representing that you have a good faith belief that the material associated with the URL infringes the copyrights in that material and that you own the copyrights in that material or are authorized to represent the owner of the copyrights. (Please note that under the DMCA any person who knowingly and materially misrepresents that material is infringing may be subject to liability.)

 

By submitting the URL's, you acknowledge and understand that the links in question will automatically be deleted. Further, you have a good faith belief that use of the copyrighted materials is not authorized by the copyright owner, its agent, or the law. You swear, under penalty of perjury, that the information is accurate and you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Links which contain files which do not belong to you shall not be included.

 

To request Takedown Access, please send an e-mail to Asfile's.al designated agent at forabuse@asfile.al. Such access is granted at the discretion of Asfile.al based on (including but not limited to) the applicants status as copyright owner and the infringing content.

 

TRADEMARKS

When content is uploaded to the Asfile.al service by users, a URL is generated which links to said content. Asfile.al does not knowingly incorporate third party trademarks into the URLs generated when content is uploaded. Further, Asfile.al does not provide an index of content available through the Asfile.al service.

 

If you believe that the Asfile.al service is being used to distribute products or services using your trademark in a manner that violates your rights as a trademark holder, you may submit a notification to Asfile.al. Use the process described above for submitting a notification of copyright infringement specifying that your notification pertains to trademark infringement by including the phrase "Trademark Notice" in the subject line of your e-mail message or letter. Moreover, pursuant to identifying the trademarked content and location, include the following statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the trademark owner, the trademark owner's agent, or the law; a statement that you are the owner or are authorized to act on behalf of the owner of the trademark that you believe is being infringed; an assurance that the information being provided is accurate and lastly your physical or electronic signature. Following receipt of a proper notification as outlined above, Asfile.al will promptly disable access to or remove content that it believes in good faith may infringe the trademark rights of third parties.

 

As an Internet Service Provider, Asfile.al, in compliance with the DMCA shall once properly notified act expeditiously to remove all infringing content and further attempt to work with the copyright owner to deal with any issues of infringement. Asfile.al offers file hosting solutions for both personal and business purposes in hosting and sharing documents, presentations, etc. and strives to assure its service is not abused. As such, our terms and conditions strictly prohibit the uploading of any and all content which infringe on any intellectual property right as well as other illegal conduct.

Counter Notification

If users believe that the use of their material was lawful, you may file a counter-notification in order to restore access to these materials , use this email: forabuse@asfile.al If you did not have all of the rights to post the material at issue, you MUST NOT submit a counter-notification. Under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be liable for damages.
